Description

A complete liberalisation of the telecommunications sector is planned for the 1st January 1998. In this context, the question is debated whether, once this liberalisation is de iure achieved. the best development of the sector would be guaranteed by the sole application of the competition rules contained in the Treaty of Rome, or whether there should also be a telecommunications sector specific regulation going beyond the mere application of competition law. Answering these questions is the aim of the proposed project. This implies both an analysis of the application of the competition rules of the Treaty of Rome to the telecommunications sector and an examination of the sector specific regulation centered around the concept of "Open Network Provision" (ONP) eventually to be extended to an "Open Network Policy". A list of regulatory topics which cannot be sufficiently covered by competition law provisions will also be identified and analysed.
